Terms of Service

1. Agreement to Terms

By accessing or using Sketchra, you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree, you may not use our platform. Sketchra is operated by PM ENT. AB, a company registered in Sweden.

2. Eligibility and Parental Consent

Sketchra is a tool designed for families. All accounts must be created and managed by an adult who is at least 18 years old. Children may use the platform under direct parental or guardian supervision.

By creating an account, you confirm that you are at least 18 years old, that you have the right to upload any drawings submitted through your account, and that you provide consent for our AI to process those drawings in order to generate new artwork.

4. Tokens and Payments

• What tokens are: Tokens are the in-app currency used to generate artwork. One token equals one generation attempt. Tokens have no cash value and cannot be transferred between accounts.
• One-time token packs: Purchased token packs are non-refundable. Tokens from one-time purchases do not expire.
• Subscription tokens: Active subscribers receive a monthly token allotment. Subscription tokens expire 14 days after the end of the billing period in which they were issued. We do not offer refunds on subscription payments except at our sole discretion for customer goodwill (e.g., accidental renewal, first-time billing disputes). Such exceptions are handled case-by-case and are not guaranteed.
• Storage retention: Active subscribers retain access to their creations indefinitely. Free-tier creations are stored for 30 days. If a subscription ends, stored creations enter a 30-day countdown before deletion; resubscribing before that deadline rescues your images permanently.
• Payment processing: All payments are processed by Stripe. We do not store your credit card or payment details on our servers. By purchasing, you also agree to Stripe's Terms of Service.

5. Acceptable Use

You agree not to upload, submit, or generate content that:

• Is illegal, harmful, threatening, defamatory, or obscene.
• Contains nudity, sexual content, or material harmful to minors.
• Infringes on the intellectual property rights of others.
• Is designed to exploit, abuse, or harm children in any way.
• Attempts to reverse-engineer, scrape, or attack the platform or its infrastructure.

Violations may result in immediate account suspension and referral to appropriate authorities where required by law.

6. Diagnostic Data

Sketchra collects limited technical metadata to help us diagnose bugs and improve the experience. This includes: browser name and version, operating system, screen resolution, and a short log of recent in-app actions (e.g., “uploaded image”, “style selected”) captured when you voluntarily submit feedback via the feedback widget. No personally identifiable information is included in this log. See our Privacy Policy for full details.

7. Service Availability and Disclaimers

Sketchra provides AI-generated content “as is.” We do not guarantee the artistic quality, accuracy, or appropriateness of any result. AI outputs can be unpredictable.

We reserve the right to modify, suspend, or discontinue any part of the service at any time with reasonable notice. We will make reasonable efforts to preserve your content before any planned service changes.

8. Limitation of Liability

To the fullest extent permitted by applicable law, PM ENT. AB shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of Sketchra, including but not limited to loss of content, loss of tokens, or service interruptions. Our total liability to you for any claim shall not exceed the amount you paid to us in the 12 months preceding the claim.

9. Account Termination

You may delete your account at any time through your account settings. Upon deletion, your data and stored creations will be permanently removed within 30 days.

We reserve the right to suspend or terminate accounts that violate these Terms, without prior notice in cases of serious violation.

10. Governing Law

These Terms are governed by and construed in accordance with the laws of Sweden. Any disputes shall be resolved in the courts of Sweden, unless mandatory consumer protection laws in your country of residence provide otherwise.

11. Changes to These Terms

We may update these Terms from time to time. When we do, we will update the “Last updated” date at the top. Continued use of Sketchra after changes are posted constitutes your acceptance of the updated Terms. For material changes, we will make reasonable efforts to notify you via email or an in-app notice.
